1. Acceptance of Terms

By accessing or using Trailkeep, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our service. Your continued use of Trailkeep constitutes acceptance of these terms and any future modifications.

2. Description of Service

Trailkeep is a web application that allows users to create hiking plans, manage gear lists, share trip information, and access safety features for outdoor activities. Trailkeep is a planning and communication tool designed to supplement—not replace—proper wilderness safety practices, training, and equipment.

3. Assumption of Risk & Wilderness Activities

Hiking, backpacking, and wilderness activities are inherently dangerous and carry significant risks including injury, death, property damage, and other harm. You acknowledge and accept all risks associated with wilderness activities. Trailkeep is a communication and planning tool ONLY and is NOT a substitute for proper wilderness training, appropriate safety gear, sound judgment, emergency preparedness, or established safety protocols. Your safety is your sole responsibility.

4. User Accounts

You may be required to create an account to use certain features of Trailkeep. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You must provide accurate, current, and complete information during registration and keep your account information updated. Notify us immediately of any unauthorized account use.

5. No Warranty of Service Availability

Trailkeep is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We make NO guarantees regarding: app availability or uptime; cellular or data connectivity; GPS accuracy or availability; emergency feature functionality; Safety QR scanning or accessibility; check-in delivery or timing; Overdue Alert delivery; or any other service functionality. The service may fail, be unavailable, or malfunction at any time, especially in wilderness and remote areas where it is most needed.

5.5. Third-Party Infrastructure Dependencies

Trailkeep relies on third-party service providers for critical infrastructure, including but not limited to hosting, content delivery networks, database services, email delivery, and authentication systems. Service availability and functionality may be affected by outages, maintenance, performance issues, or failures of these third-party providers, which are beyond our control. We are NOT LIABLE for any service disruption, data unavailability, or loss resulting from third-party service failures, including but not limited to CDN outages, hosting provider downtime, or infrastructure incidents.

6. Emergency Features Disclaimer

Safety QR, Overdue Alerts, check-ins, trip sharing, and all safety-related features are SUPPLEMENTARY TOOLS ONLY. They are NOT replacements for satellite emergency devices (PLB, inReach, SPOT); guarantees of rescue or emergency response; substitutes for proper wilderness safety equipment; or reliable in areas without cellular coverage. These features may fail when you need them most. Always carry appropriate emergency equipment and do not rely solely on Trailkeep for safety.

6a. Satellite SMS Check-in Feature

Trailkeep offers an optional satellite check-in feature that allows you to send a pre-formatted SMS to our service number (+1 833 676 0717) as a fallback when you have no internet connection. By using this feature, you acknowledge and agree that: (a) standard carrier SMS and data rates charged by your mobile operator may apply; (b) delivery of the check-in depends entirely on third-party infrastructure including your mobile carrier, satellite providers (such as Apple/Globalstar, SpaceX Starlink, or Skylo), and Telnyx's SMS infrastructure, none of which are operated or controlled by Trailkeep; (c) we do not guarantee that a message sent via this feature will be received, processed, or acted upon; (d) this feature is a supplementary fallback path and does not replace the need for proper emergency preparedness equipment; and (e) you are voluntarily initiating the SMS from your own device and are responsible for any costs incurred in doing so. Use of this feature is subject to the same disclaimers and limitations of liability set out in these Terms.

7. No Search and Rescue Responsibility

Trailkeep is a DATA COMMUNICATION CHANNEL ONLY. We do NOT conduct Search and Rescue (SAR) operations; coordinate with SAR teams; monitor user locations or safety in real-time; guarantee SAR teams will access or use your data; or assume any responsibility for SAR response time, quality, or outcomes. If SAR teams access your shared trip data, they do so independently. Trailkeep has no control over, responsibility for, or liability related to any SAR operations or emergency response activities.

8. User Responsibility for Safety

You are solely and entirely responsible for: proper trip planning and wilderness risk assessment; carrying appropriate safety, survival, and emergency gear; obtaining wilderness first aid training and emergency skills; informing others of your trip plans beyond Trailkeep; carrying satellite emergency communication devices in remote areas; making sound judgment calls in the field; your own rescue and emergency preparedness; and all aspects of your personal safety during wilderness activities.

9. User Content

You retain all rights to the content you post on Trailkeep. By posting content, you grant Trailkeep a non-exclusive, worldwide, royalty-free license to use, modify, and display that content in connection with the service. You represent that you have all necessary rights to post your content and that it does not violate any laws or third-party rights.

10. Prohibited Conduct

You agree not to engage in any conduct that could damage, disable, overburden, or impair Trailkeep's servers or networks, or interfere with any other party's use and enjoyment of the service. You may not use the service for any illegal purpose, attempt to gain unauthorized access to the service or related systems, or engage in any activity that violates these Terms.

11. Intellectual Property

The Trailkeep service and its original content, features, and functionality are owned by Trailkeep and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not copy, modify, distribute, sell, or lease any part of our service without explicit written permission.

12. Indemnification

You agree to indemnify, defend, and hold harmless Trailkeep and its officers, directors, employees, contractors, agents, and affiliates from any claims, lawsuits, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from: your use of wilderness areas and outdoor activities; your reliance on Trailkeep features for safety purposes; Search and Rescue operations related to your activities; emergency situations where app features failed or were unavailable; third parties accessing your shared trip data; your violation of these Terms; or your violation of any rights of another person or entity.

13. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Upon termination, your right to use the service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Cancelling a paid subscription is not the same as terminating your account. Subscription cancellation ends your billing cycle at the next renewal date; your account and all data remain intact and you retain access to the free tier. Account termination (above) is a separate action taken by Trailkeep for breaches of these Terms and results in loss of access to the service.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: Trailkeep and its directors, employees, partners, agents, suppliers, and affiliates shall NOT be liable for ANY damages whatsoever, including but not limited to direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use or inability to use the service; wilderness activities or outdoor recreation; injury, death, or rescue costs; property loss or damage; app failures, malfunctions, or unavailability; data loss or corruption; connectivity or GPS issues; emergency feature failures in critical situations; reliance on app information for safety decisions; or any other matter relating to Trailkeep. This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if Trailkeep has been advised of the possibility of such damages.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting a notice on our website or sending you an email. What constitutes a material change will be determined at our discretion. By continuing to use Trailkeep after revisions become effective, you agree to be bound by the revised terms.

16. Database Changes

We reserve the right to modify, update, or delete database details of your user account if we deem it necessary for service operation, security, legal compliance, or any other reason. In such cases, we will make reasonable efforts to notify you of the changes via the Trailkeep app or email, but are not obligated to do so. You acknowledge that data loss may occur and agree to maintain your own backups of critical trip information.

17. Subscription Plans and Billing

Trailkeep offers a free tier and a paid subscription (Pro). The specific features and limits of each tier are described at trailkeep.com/pricing.

Auto-renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price. We will send you a reminder email before each renewal. You will be charged to your payment method on file unless you cancel before the renewal date.

Cancellation. You may cancel your subscription at any time via the Billing section of your account settings. Cancellation takes effect at the end of your current billing period. You retain full access until then. See §13 for the distinction between subscription cancellation and account termination.

Right of withdrawal. Under EU consumer law (Directive 2011/83/EU), you have a statutory 14-day right of withdrawal from the date your subscription begins. At the time of purchase, we will ask for your express consent to begin the service immediately; if you consent, you acknowledge that your 14-day right of withdrawal is waived from that point. If you do not consent to immediate commencement, your subscription begins on day 15 and the 14-day window passes without charge. If you exercise your right of withdrawal within 14 days and have not yet accessed paid features, you are entitled to a full refund. If you have accessed paid features during that period, we will charge a proportionate amount for the service provided up to the date of withdrawal and refund the remainder. After 14 days, subscriptions are non-refundable. To exercise your right of withdrawal, contact info@trailkeep.com within the 14-day period.

Downgrade behaviour. If your subscription lapses or you cancel, your existing data is never deleted. You retain read and write access to all existing trips, gear lists, and itineraries regardless of how many you have. Creation of new items above the free tier limits is blocked until you re-subscribe. Collaborative editing sessions started by your account become read-only at the end of your billing cycle.

Pioneer access. Users who received Pioneer access before March 2026 hold lifetime access at no charge. Users who received Pioneer access from March 2026 onwards were granted time-limited access expiring on December 31, 2026. The expiry date for your account is shown in your account settings under Billing. After expiry, your account reverts to the free tier automatically. Your data is unaffected.

Payment processing. Payments are processed by Stripe, Inc. By subscribing, you agree to Stripe's terms of service (stripe.com/legal). Trailkeep does not store your payment card details.

18. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia and the European Union, without regard to conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of Estonia for resolution of any disputes arising from these Terms or your use of Trailkeep.
